Settlement conference is a mandatory and important step in the Small Claims Court process in Ontario. After each party has filed its defence, the small claims court office schedules a date for parties to attend a settlement conference. The settlement conference is presided by a Deputy Judge. The Deputy Judge at the settlement conference cannot be the trial judge for the same case. This is to ensure that parties can speak freely at their settlement conference and explore resolution of their case without spending further time and money. Settlement conference is also a great opportunity to get some understanding of the merits of ones case through the eyes of a non-partisan Deputy Judge. This course explains everything you need to know to prepare for a settlement conference: what small claims court forms to complete – e.g. list of witnesses and additional documents form; and how to prepare and negotiate at settlement conference.
