Drafting and Filing the Complaint
The plaintiff (the person bringing the case) files a complaint or petition in court, outlining the issue and the relief they are seeking.
Step 3: Serving the Defendant
The defendant must be formally notified of the lawsuit through a legal process known as service of process.
Step 4: Response from the Defendant
The defendant may respond by admitting, denying, or contesting the claims. In some cases, they may also file a counterclaim.
Step 5: Pre-Trial Proceedings
This phase includes discovery (exchange of evidence), motions, and sometimes mediation or settlement discussions.
Step 6: Trial
If no settlement is reached, the case proceeds to trial, where both sides present their evidence and arguments.
Step 7: Judgment and Enforcement
The court issues a judgment. If the losing party does not comply voluntarily, enforcement measures may be taken.
